Terms and Conditions for Music Submissions to Indie Pulse Radio Show

Effective Date: February 1, 2026

These Terms and Conditions ("Terms") govern the submission of music by artists ("You" or "Artist") to the Indie Pulse radio show ("Show"), broadcast on Radio Hawkes Bay and affiliated stations across New Zealand ("Stations"). By submitting music to the Show, You agree to be bound by these Terms. If You do not agree, do not submit any music.

The Show is produced by Indie Pulse ("We," "Us," or "Our"). We reserve the right to update these Terms at any time, and continued submissions after changes constitute Your acceptance.

1. Eligibility

• You must be at least 18 years old or the age of majority in Your jurisdiction to submit music.
• Submissions are open to independent artists or those with appropriate rights to the submitted material. Major label artists or those under exclusive contracts should confirm eligibility with their representatives.
• Music must be original or You must hold all necessary rights, licenses, and permissions for submission and broadcast.
• We encourage submissions from New Zealand-based artists but accept international entries, subject to compliance with New Zealand laws, including those under the Copyright Act 1994.

2. Submission Process

• Submit music via our online form at https://indiepulse.woo.co/artists. 
• Required information: contact information, artist name, track title, accessible link to the track's wav file, accessible link to the track's cover image, and completion of a full artist's profile (here: https://indiepulse.woo.co/manage-profile ).
• File formats: High-quality WAV file.
• There is no fee for submissions.
• All submissions become Our property for review purposes but do not transfer ownership of Your music.
• We may acknowledge receipt but are not obligated to respond to every submission.

3. No Guarantee of Airplay

• Submission does not guarantee selection, broadcast, or promotion on the Show or Stations.
• Selection is at Our sole discretion, based on criteria such as quality, relevance to indie genres, and programming needs.
• If selected, We will notify You where possible, but broadcast may occur without prior notice.

4. Grant of Rights

• By submitting, You grant Us a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to:
  • Broadcast, stream, and publicly perform the submitted music on the Show, Stations, and associated platforms (e.g., online streams, podcasts, social media clips).
  • Use excerpts for promotional purposes, including but not limited to trailers, ads, and website features.
  • Store and archive the music for internal use.
• This license includes rights to synchronize the music with other content where necessary for broadcast.
• You retain ownership of Your music and may continue to use, license, or distribute it elsewhere.
• If Your music includes samples, covers, or third-party elements, You confirm You have cleared all rights (e.g., via APRA AMCOS for New Zealand performing rights).

5. Representations and Warranties

You represent and warrant that:

• You are the sole owner or authorized rights holder of the submitted music, including composition, lyrics, recordings, and performances.
• The music does not infringe any third-party rights, including copyrights, trademarks, privacy, or publicity rights.
• The music complies with New Zealand laws, including the Broadcasting Act 1989 and Copyright Act 1994, and does not contain defamatory, obscene, or unlawful content.
• All information provided in Your submission is accurate and truthful.
• You have obtained consents from all featured artists, producers, or contributors.

6. Indemnification

• You agree to indemnify, defend, and hold harmless Us, the Stations, Our affiliates, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:
  • Any breach of these Terms, including Your representations and warranties.
  • Any third-party claims related to the submitted music (e.g., copyright infringement).
  • Your use of Our platforms or services.
• We reserve the right to assume control of any defense, at Your expense.

7. Data Privacy

• We collect personal information (e.g., name, email, bio) as part of submissions.
• This data is handled in accordance with New Zealand's Privacy Act 2020. We use it for review, communication, and promotion purposes.
• We may share Your data with affiliated Stations or partners for broadcast-related activities.

• You may access and update your data here: https://indiepulse.woo.co/your-info and/or request access, correction, or deletion of Your data by contacting Us.

8. Limitation of Liability

• To the extent permitted by law, We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from Your submission or use of Our services, including loss of data, opportunities, or profits.
• Our total liability shall not exceed NZD $100.
• We do not warrant that broadcasts will be error-free or uninterrupted.

9. Termination and Withdrawal

• You may withdraw a submission by written notice one week (7 days) before broadcast, but We are not obligated to remove archived or already-aired content.
• We may terminate Your submission or license at any time for any reason, including breach of Terms.

10. General Provisions

• These Terms are governed by the laws of New Zealand, without regard to conflict of laws principles.
• Any disputes shall be resolved exclusively in the courts of New Zealand, with venue in Hawke's Bay.
• If any provision is unenforceable, the remainder remains in effect.
• These Terms constitute the entire agreement between You and Us regarding submissions.
• Force majeure: We are not liable for delays or failures due to events beyond Our control (e.g., natural disasters, technical issues).
